By purchasing any products available on our platform, you agree to comply with and be bound by these Terms and Conditions (“Terms”). Please read these Terms carefully before using our services. If you do not agree to these Terms, you must refrain from using our website and purchasing our products. Your continued use of our services constitutes your acceptance of these Terms.
Eligibility to Use
To access or use our website, you must be at least 18 years old or have reached the age of majority in your jurisdiction. By using our services, you represent that you have the legal capacity to enter into a binding agreement and comply with these Terms.
1. Compliance Responsibilities You, the agent, are solely responsible for ensuring compliance with all applicable laws and regulations, including but not limited to: Centers for Medicare & Medicaid Services (CMS) regulations, Federal Communications Commission (FCC) regulations, State and Federal governing agencies. It is your responsibility to stay informed about and adhere to these regulations at all times.
2. Lead Lists: You are required to provide your own lists for the Medicare Appointment Setters program. If Medicare Appointment Setters recommends a vendor or source for purchasing phone lists, you acknowledge that it is your responsibility to ensure that any list obtained is compliant with all applicable laws and regulations. Medicare Appointment Setters shall not be held liable for any compliance issues arising from your use of third-party lists.
3. No Refund Policy: Once the delivery of telemarketing services is completed, all sales are final, and no refunds will be issued under any circumstances. Delivery of telemarketing services is defined as once you are assigned a telemarketer, and they have successfully begun calling or they have completed two full working days. After delivery, you are responsible for keeping up with your monthly expenses, including paying your telemarketer (paid weekly), your CRM, and your list generation company.
4. Limitation of Liability: Medicare Appointment Setters or its Owners will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Medicare Appointment Setters program, including but not limited to any claims arising from non-compliance with laws or regulations. You agree to indemnify and hold us harmless, our subsidiaries, affiliates, related parties, officers, directors, employees, agents, independent contractors, advertisers, partners, and co-branders from any claim or demand, including reasonable attorney's fees, that may be made by any third party, that is due to or arising out of your conduct or connection with this website or Service, your violation of these Terms of Use or any other violation of the rights of another person or party.
5. Changes to Terms: Medicare Appointment Setters reserves the right to modify these terms and conditions at any time. Any changes will be effective immediately upon posting on our website. Your continued use of the program constitutes your acceptance of any changes.
6. Governing Law: These terms and conditions shall be governed by and construed in accordance with the laws of South Carolina. Any disputes arising from these terms will be handled in the appropriate court in South Carolina.
